SALES AND DELIVERY CONDITIONS
These Sales and Delivery Conditions apply to all online transactions with PHILOMIJN. Please read these carefully before placing your order. All agreements are governed by the laws of the Netherlands and will be interpreted accordingly; any disputes between parties in respect of or in connection with agreements to which these Sales and Delivery Conditions apply will be subject to the exclusive jurisdiction of the courts of the Netherlands.
Your placement of an order with PHILOMIJN also indicates your acceptance of these Sales and Delivery Conditions. These Conditions may change without prior notice and it is the customer’s duty to carefully review these Sales and Delivery Conditions prior to placing an order.
All references to “the company", “we” or “us” refer to PHILOMIJN. All references to the customer refer to the person or persons who buy goods from the company, or who commit to the purchase of products from the company.

THE PRODUCTS
A complete and accurate description of all available products is provided. We make every endeavour to ensure that the colours you see on the website correspond as much as possible to the actual product. Due to technical constraints, colours may not always be exactly the same.

PRICES AND ERRORS
All prices are quoted in euros (€), inclusive of applicable VAT in the Netherlands. Prices and specifications are monitored as much as possible, however, liability for errors and omissions will not be accepted, although every effort is made to ensure the utmost accuracy at all times. We reserve the right to change our prices and specifications without prior notification.

ORDERS
After placing your order in our web shop, you will receive an acknowledgement by email. This email will confirm our contact details, the requested products, the total cost (including VAT), and delivery and invoice details.

DELIVERY/SERVICE COSTS
The handling costs for postal package orders from The Netherlands are € 8,00 euro and 3,00 for mailbox orders. For orders from other countries FAQ’s on our website.
Important note: Countries outside the European Union might demand an additional import duty that you have to pay at delivery. These import conditions/duties differ per country. Please contact your national Custom House for more information.

RESPONSIBILITY OF THE CUSTOMER
The customer is responsible for completing the online order form as fully and as accurately as possible. If the information supplied by the customer is incomplete, misleading or inaccurate, the customer is liable for all costs which may arise from resolving the matter.

DELIVERY
Every effort will be made to deliver the goods ordered as quickly as possible. Please note, we only ship on Monday and Wednesday. If we are unable to deliver your products within thirty days, we will immediately inform you of the anticipated delivery date.
In the event that we are unable to process your order straight away we will immediately notify you of any unexpected delay, or indicate the reason. If the product is no longer in stock, or should you no longer wish to wait for the article, we will cancel your order. Your money will then be refunded.
In the event of any damages during shipment of our products, or if any of the articles on the packing list are missing, or if the articles delivered do not correspond with your order, you should notify us within seven days of receipt of the products and provide us with all the necessary information. If we do not receive such notification, it will be assumed that the customer has accepted delivery of the articles. We are not liable for any consequential damages arising from delayed delivery or non-delivery by the shipping agent appointed by the company.
PHILOMIJN does not accept any liability for non-delivery of products, delay, damages or inadequacies if the circumstances are reasonably outside of our control.

RETURNS AND EXCHANGES
All articles may be returned within seven working days without reason. This seven days reflexion period commences on the day after receipt of the product by or on behalf of the consumer. During this period, you can return the products – unused and undamaged – in the original packaging. Please take into account that the returned goods must be in a condition corresponding to normal use, such as trying on for admiring, as is usual in conventional shops when trying on/admiring:
  • The products have not been used, they are not dirty.
  • The products are returned in the original, undamaged packaging.
  • The products are complete.
  • The products must have their original label.
If the returned goods do not meet the above requirements, we reserve the right to demand compensation.
When returning goods you should notify us via webshop@philomijn.com. The costs for returning goods are for your own account. After expiry of the reflexion period the purchase agreement will come into force.

GUARANTEE
Leather is not manufactured it grows. It's a natural product. We love it the way it and it becomes more pretty while using it. The natural characteristics of the skin and scars maybe visible in the leather. There can not vouch for deviations in color and or discolor and release of the leather.

PHILOMIJN products have been manufactured with the best possible care and workmanship and are guaranteed against manufacturing. It does not cover normal wear and tear nor any alterations made by the customer. Damage due to anything other than manufacturing or material faults will not be covered by any form of warranty, but can be repaired at a reasonable charge. If you’d like to use this service or make a warranty claim, please contact our Customer Service. They will inform you about the procedure.

COMPLAINTS
Any complaints may be sent to our Customer Services. We endeavour to handle complaints within five days after receipt. If we are unable to resolve your complaint immediately, we will indicate a realistic time schedule and keep you informed of progress.

PROTECTION OF PRIVACY
The protection of privacy extends to PHILOMIJN and its websites. All information supplied by the user – unless explicitly agreed otherwise – shall be treated as confidential and will not be disclosed by PHILOMIJN to third parties, unless this is legally required or if asked to do so by a judicial body.

Liability
Any liability of PHILOMIJN, its staff and the products of PHILOMIJN for all damages of any kind, directly or indirectly, including loss of profits, consequential damage to movable or immovable property or to any person, is specifically excluded. PHILOMIJN cannot be held liable for damage caused by the implementation of the agreement by third parties.
PHILOMIJN assumes no liability for any damage arising from the use of the products of PHILOMIJN.
Any liability of PHILOMIJN towards buyer cannot in any case exceed the invoiced amount that the buyer under the agreement relating to PHILOMIJN is due.
For misunderstandings, mutilations, delays or not properly conveyed orders and notices as a result of the use of the Internet or any other means of communication in the communication between client and PHILOMIJN, or between PHILOMIJN and third parties, as it relates to the relationship between you and PHILOMIJN, PHILOMIJN is not liable, unless and where there might be proof of intent or gross negligence of PHILOMIJN.

Force majeure
PHILOMIJN has, in case of a force majeure, the right, at its opinion, to suspend or terminate the contract without judicial intervention. PHILOMIJN will inform the client in writing. In this case PHILOMIJN is not obliged to any compensation, unless standards of reasonableness and fairness determine otherwise.  Force majeure means any deficiency that cannot be blamed on PHILOMIJN, because it is not due to its fault. Neither under Dutch law, nor based on generally accepted practice.

Applicable law and jurisdiction
On all rights, obligations, offers, orders and agreements to which these conditions apply, as well as these conditions, only Dutch law applies.
All disputes between parties will only be submitted to the competent court in Arnhem  - the Netherlands.
